1. Acceptance of Terms
These Terms of Service (referred to as "Terms") establish a legally binding agreement between you and Extreme Software (a division of Extended Results Inc., collectively referred to as "we," "us," or "our"). These Terms govern your access to and use of the Fast Stats Sports mobile scorekeeper application, our website, and all associated stats trackers, shot chart calculators, player portfolio generators, and digital scorebooks (collectively, the "Fast Stats Platform").
Please read these Terms carefully before utilizing any portion of the Fast Stats Platform. By accessing, downloading, or using the Fast Stats Platform, you agree to be bound by these Terms, including the binding arbitration and class action waiver clauses outlined in Section 12. If you do not agree to these Terms, you are prohibited from using the Fast Stats Platform.
We reserve the right to revise, update, or alter these Terms at any time. Any changes will be posted to this page with an updated "Effective Date." Your continued use of the platform after updates are made constitutes your official acceptance of the modified Terms.
2. User Eligibility
To use the Fast Stats Platform, you must meet the following eligibility requirements:
- Age Limit: You must be at least 13 years of age. If you are under the age of 18, you must have the permission of a parent or legal guardian to utilize the platform.
- Authorized Youth Profiles: In compliance with child privacy laws, player profiles for youth athletes under the age of 13 must be created and managed exclusively by adult administrators, such as coaches, school athletic coordinators, or parents.
- Account Status: You must not have had a previous Fast Stats Sports account disabled for violation of our community standards or applicable laws.
- Geographical Restrictions: The Fast Stats Platform is controlled from our offices in the United States. If you access the service from outside the United States, you are solely responsible for compliance with your local laws.
3. Account Registration and Security
Some premium or personalized features of the platform require you to establish a user account. You agree to provide accurate, current, and complete registration details and to update this information immediately if it changes.
Account Confidentiality: You are solely responsible for safeguarding the credentials of your account, including your password. You agree to accept liability for any actions, updates, or purchases made through your active account session. If you suspect unauthorized access, you must notify support immediately.
We reserve the right to suspend, terminate, or refuse access to your account at our sole discretion if we detect fraudulent activity, security breaches, or violations of these Terms.
6. User Content and Licensing
You retain all ownership rights to any materials you submit, upload, or record on the platform—including team rosters, player jersey numbers, scores, play-by-play logs, court shot coordinates, and team photos ("User Content").
To allow us to run the scorebook platform and calculate advanced statistics, you grant us a specific license:
- License Scope: You grant Extreme Software and Extended Results Inc. a perpetual, irrevocable, royalty-free, worldwide, non-exclusive license to host, store, replicate, compute, modify, display, and distribute your User Content for the purpose of operating the Service.
- Data Sharing: This license includes the right to display roster sheets, box scores, shot charts, and computed metrics (eFG%, TS%, rebound/turnover ratios) to members linked to your team page, and to the public if you explicitly mark your team data or player portfolios as "Public" or shareable.
- Content Warranty: By publishing User Content, you represent that you own the content or have obtained all necessary third-party consents (including parental consent for minor team players) to record and display performance statistics. You agree that you will not post content that violates copyright, trademark, or personal privacy laws.
7. Community Guidelines and Sportsmanship
We strive to foster a safe, respectful, and competitive environment for athletes, coaches, and recruiters. You are prohibited from abusing the Fast Stats Platform or using its posting interfaces to:
- Upload, record, or transmit profane, offensive, threatening, defamatory, or obscene text, team names, or player profiles.
- Harass, bully, discriminate against, or intimidate other players, coaches, parents, or user groups.
- Infringe the copyright, trademark, or trade secret rights of any third party.
- Distribute spam, chain letters, automated scripts, scrapers, or unauthorized promotional materials.
- Interfere with, tamper with, or attempt to breach the database servers, security architecture, or networks of the Fast Stats Platform.
Decisions to modify rosters, delete offensive comments, or terminate accounts for code of conduct violations are exercised at our sole discretion.
8. Intellectual Property Rights
All materials provided on the Fast Stats Platform—including application software, user interfaces, branding, sports logos, scorekeeping graphics, databases, proprietary statistical algorithms, and general content (collectively, "Content")—are the exclusive property of Extreme Software, Extended Results Inc., or their licensors.
We grant you a limited, non-transferable, revocable license to download the mobile application and access platform interfaces strictly for your personal, non-commercial use. You may not copy, reverse-engineer, modify, distribute, or create derivative works from our software or Content without express written authorization.
9. Disclaimer of Warranties
AS-IS Provision: THE Fast Stats PLATFORM AND ALL ASSOCIATED PERFORMANCE DATA, SCORE BOOKS, AND SHOT CHARTS ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
Without limiting the foregoing, we do not warrant that: (i) the basketball stats calculations, box scores, or metrics are 100% error-free or mathematically flawless under all scoring circumstances; (ii) platform operations will be completely uninterrupted, timely, or secure; or (iii) cloud synchronization will never suffer temporary database latency or data packet loss. You should regularly maintain offline backup logs of key game statistics.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL EXTREME SOFTWARE, EXTENDED RESULTS INC., OR THEIR ASSOCIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PERFORMANCE DATA, SCOUTING OPPORTUNITIES, SUBSCRIPTION CREDITS, OR REVENUE LOSS) ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE Fast Stats PLATFORM.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS EXCEED THE ACTUAL SUBSCRIPTION FEES PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to defend, indemnify, and hold harmless Extreme Software, Extended Results Inc., and their directors, employees, and agents from and against any claims, losses, damages, liabilities, and legal expenses (including reasonable attorneys' fees) arising from: (i) your unauthorized use or misuse of the Fast Stats Platform; (ii) your violation of these Terms; or (iii) any copyright, privacy, or performance-right infringement claims stemming from your User Content.
12. Binding Arbitration of All Disputes; Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT INFLUENCES YOUR LEGAL RIGHTS, REQUIRING DISPUTES TO BE ARBITRATED INDIVIDUALLY AND ELIMINATING THE RIGHT TO A JURY TRIAL OR CLASS-ACTION ACTION LAWSUITS.
- Mandatory Arbitration: Except for disputes involving the enforcement of intellectual property rights or small claims court cases, any dispute between you and Extreme Software / Extended Results Inc. arising under these Terms shall be resolved exclusively through binding arbitration administered by JAMS in accordance with the JAMS Streamlined Arbitration Rules.
- Substantive Law: The arbitrator shall apply the substantive laws of the State of Washington, without regard to conflict of laws principles. The Federal Arbitration Act ("FAA") shall govern the construction and enforcement of this arbitration agreement.
- Individual Basis Only: You and we agree that all claims must be pursued solely on an individual basis. BY AGREEING TO THESE TERMS, YOU WAIVE THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION, REPRESENTATIVE PROCEEDING, OR CONSOLIDATED ARBITRATION.
- Hearing Venue: Arbitration hearings will be conducted in King County, Washington, or, at your selection, by telephone or written submission for claims seeking $10,000 or less.
13. Governing Law
These Terms, your access to the Fast Stats Platform, and any non-arbitrable disputes shall be governed by, and construed in accordance with, the laws of the State of Washington, United States, without regard to choice of law rules.
14. Account Inactivity and Data Retention
To maintain optimal cloud database performance, we enforce automated data cleanup policies:
- Subscription Cancellation: If you cancel a Premium Service, we may permanently delete any advanced archived historical rosters or shot logs after thirty (30) days following cancellation.
- Inactive Free Accounts: If a free tier user account remains inactive for a consecutive period of ninety (90) days or more, we reserve the right to permanently purge and delete all statistical data sheets associated with that account. Inactivity is defined as a failure to log into the platform or submit any game telemetry.

5. Social Sign-On Integrations
We support single sign-on authentication through third-party networks (Apple, Google, or Facebook) to simplify account creation. Your use of these sign-on networks is subject to the terms and privacy regulations of those third parties. If a third-party single sign-on service becomes unavailable or is unlinked by you, you may need to establish an independent password with Fast Stats Sports to access your account data.
